Expedited Examination For Patents

EXPEDITED EXAMINATION FOR PATENT APPLICATIONS IN MALAYSIA



With effect from 15 February 2011, an Applicant of a Malaysian patent application can request for expedited examination of its application through to registration in circumstances that are justified. This is particularly useful in cases where the Applicant is seeking to pursue an injunction or infringement action etc.

In this regard, Applicants must submit a request for approval for expedited examination with the prescribed payment, after eighteen months from the priority date or filing date of the Malaysian application and providing adequate specific reasons for wanting the application to be expedited such as pursuit of injunction or infringement action etc.


Applicants who opt for expedited examination will be required to respond to an examination report within three (3) weeks from the date of mailing of the examination report, as opposed to two (2) months in the case of the normal route. Failure to respond to the examination report within the stipulated timeline will result in the request of expedited examination being withdrawn and the normal examination process and timeline will automatically apply.


The expedited route only applies to Paris Convention and non-PCT applications.
